Supreme Court Declines To Free Nnamdi Kanu

The Supreme Court made a significant decision on Friday regarding the detention of Nnamdi Kanu, the leader of the Indigenous People of Biafra (IPOB), choosing not to order his release.

According to a report, Justice Emmanuel Agim delivered the judgment on behalf of the court, penned by Justice Garba Lawal. This judgment overturned the Court of Appeal’s previous ruling from October, which had ordered Kanu’s release and dismissed the terrorism charges against him.

The Supreme Court clarified that while Kanu was indeed unlawfully taken from Kenya by the Nigerian government, this act, though reckless and illegal, does not strip any court of its authority to proceed with the trial.

Justice Lawal emphasized that the lawsuit seeking Kanu’s release solely on grounds of an unlawful abduction from Kenya did not reference any specific Nigerian law. He suggested that the appropriate recourse in such a situation would be for Kanu to pursue a civil case against this unlawful act instead of halting the court’s ability to continue his trial on alleged criminal charges.

Consequently, the apex court directed Kanu to present himself and defend against the remaining 7 counts of terrorism charges brought against him.
